En el mundo interconectado de hoy, los matrimonios internacionales son cada vez más frecuentes. Dos personas de diferentes países se conocen, crean vínculos afectivos entre sí y deciden casarse a pesar de que sus nacionalidades, y a veces sus idiomas, son diferentes. Dichos matrimonios pueden unir a personas de diferentes culturas y dar lugar a relaciones únicas.

En Guatemala, el Código Civil define el matrimonio como una institución social por la que un hombre y una mujer se unen legalmente, con ánimo de permanencia y con el fin de vivir juntos, procrear, alimentar y educar a sus hijos, y auxiliarse entre sí.

Para que un matrimonio entre un guatemalteco y una extranjera o una guatemalteca y un extranjero se celebre en el territorio guatemalteco, se debe cumplir con el mismo procedimiento de un matrimonio entre guatemaltecos, pero además se deben cumplir los requisitos adicionales siguientes:

• Si la persona contrayente es extranjera, esta debe presentar su pasaporte vigente y una constancia de soltería para demostrar su libertad de estado.

• Asimismo, antes de que se celebre el matrimonio, se deben publicar edictos, por 15 días en el Diario Oficial y en otro de mayor circulación, con el objeto de que si alguien tiene conocimiento de algún impedimento legal para que la pareja contraiga matrimonio, esta pueda denunciarlo.

• Ambas partes deben presentar un certificado médico para constatar que ninguno de los dos padece de enfermedades contagiosas incurables que puedan perjudicarlos el uno al otro o a su descendencia, o que no tienen defectos físicos que impidan su procreación. 

• Si la mujer es guatemalteca y el hombre extranjero es obligatorio celebrar capitulaciones matrimoniales con un notario guatemalteco con el propósito de establecer y regular el régimen económico del matrimonio.

• Si alguna de las partes contrayentes no habla español, se requerirá la presencia de un traductor o intérprete autorizado en la República de Guatemala durante la celebración del matrimonio.

En resumen, la documentación que los contrayentes deben facilitar es la siguiente:

• Documento de Identificación Personal (DPI del contrayente guatemalteco)

• Pasaporte vigente (del contrayente extranjero)

• Certificados de nacimiento

• Constancias de soltería

• Constancias de sanidad

• Edictos

• Capitulaciones matrimoniales

Una vez se haya celebrado el matrimonio, este se inscribirá en el Registro Nacional de las Personas (RENAP).

También es muy importante tener en cuenta que si los documentos vienen del extranjero deben traer su respectiva apostilla; asimismo, si cualquiera de los documentos anteriores se encuentra en un idioma distinto al español, se debe proceder a su debida traducción por traductor jurado autorizado en la República de Guatemala.

In today’s interconnected world, international marriages are more and more frequent. Two persons from different countries meet, build affectional bonds with each other, and then decide to get married despite their nationalities, and sometimes their languages, aren’t the same. Such marriages can unite persons from different cultures and lead to unique relationships.

In Guatemala, the Civil Code defines marriage as a social institution by which a man and a woman unite legally, with intent of permanency and with the purpose of living together, procreate, feed, and educate their children, and assist one another.

For a civil marriage between a male Guatemalan and a female foreigner or a female Guatemalan and a male foreigner to be celebrated in Guatemalan territory, you must comply with the same process of a matrimony between Guatemalans, but also you must also comply with the following additional requirements:

• If the contracting party is a foreigner, he or she must provide his/her current passport and an unmarried status certificate to prove his/her status of single person.

• Additionally, before celebrating the marriage, public notices must be published for 15 days in the newspaper 'Diario Oficial' and in another newspaper of major circulation. The purpose of this is if someone knows of any legal impediment for the couple to get married, he or she can report it.

• Both parties must provide a medical certificate to confirm that neither of them suffers from incurable or contagious diseases that might damage one another or their descendants, or that they do not have physical defects that can prevent their procreation.

• If the female contracting party is Guatemalan and the male contracting party is a foreigner, it is mandatory to create marriage articles (a prenuptial agreement) before a Guatemalan notary with the purpose of establishing and regulating the economic regime of marriage.

• If either of the contracting parties does not speak Spanish, the presence of a translator or interpreter authorized in the Republic of Guatemala will be required during the celebration of the civil marriage.

In summary, the contracting parties must provide the documentation below:

• Personal Identification Document (DPI of the Guatemalan contracting party)

• Current passport (foreigner contracting party only)

• Birth certificates

• Unmarried status certificates

• Good health certificates

• Public notices

• Marriage articles (Prenuptial agreement)

• Once the civil marriage has been celebrated, it will be registered in the National Registry of Persons (RENAP by its acronym in Spanish).

It is also very important to bear in mind that if any of the documents above come from abroad, they must have the correspondent apostille; and also, if the documents are written in a language other than Spanish, they must be duly translated into Spanish by an authorized sworn translator in the Republic of Guatemala.
